Cautēl

Cautēl (v. lat. Cautēla), 1) Vorsichtsmaßregel, Behutsamkeit; 2) bes. in Rechtsgeschäften Verwahrung, z.B. gegen Mißdeutungen u. einseitige Auslegungen; 3) die Worte od. Sätze, worin eine solche Behutsamkeit od. Verwahrung enthalten sind; z.B. Cautēla Socīni, der Vorbehalt im Testamente, daß ein Notherbe, dessen Pflichttheil zwar beschwert, aber durch einen zugedachten Vortheil wieder vermehrt worden ist, dieses Vortheils verlustig sein soll, falls er sich die Beschwerung nicht gefallen lassen will. Daher Cautelarjurisprudenz, der Theil der Rechtswissenschaft, welcher lehrt, rechtliche Geschäfte in der Weise vorzunehmen u. abzuschließen, daß sie gegen Anfechtungen möglichst gesichert sind.
