Prorogation

Prorogation (v. lat.), 1) so v.w. Verlängerung, Aufschub, z.B. P. der Fristen, die Erstreckung einer Frist auf einen neuen Zeitraum; P. der Gerichtsbarkeit (P. fori), im Civilprocesse der Fall, wenn die beiden streitenden Theile entweder durch ausdrücklichen Vertrag, od. auch stillschweigend, durch Einlassung des Beklagten auf die Klage, darein willigen, daß ein an sich nicht competentes Gericht die Instruction u. Entscheidung des Rechtsstreites übernehme. Prorogativer Gerichtsstand, die Competenz eines Gerichtes, welche auf diese Weise entstanden ist.
